Rental Terms and Conditions

Definition of Terms

1. Definitions

The Rental Agreement pertains to the rental of head accessories from Mangata Store B.V to individuals or commercial enterprises (Lessee). These general terms and conditions are applicable to all contracts between Mangata Store B.V. and customers for the rental of head accessories.

2. Rental Agreement

2.1. The Lessor undertakes to provide the Lessee, for a fee, temporary use (Rental) of items (hereinafter referred to as the "Item"), and the Lessee undertakes to accept the Item, return it in a timely manner, and pay the rental fee.

2.2. The Item provided under this Agreement is to be used by the Lessee for its intended purpose. The Lessee is obliged to handle the Item with care during its use.

3. Rental Fee and Payment Procedure

3.1. The rental fee for each Item or multiple Items together is determined on the mangata-store.com website. The Lessee is obligated to pay the rental fee for the Item(s) as indicated on the order page. The rental fee includes minor repairs (such as torn seams, detached buttons or beads/sequins), and overall dry cleaning, including easy-to-remove stains.

3.2. The Lessee must pay the full rental cost of the Item.

3.3 The Lessee must provide the Lessor (1) a photocopy of a valid ID card or Passport and a credit card or (2) a photocopy of valid ID card or Passport and a deposit. Personal information will be processed by Lessor in accordance with the Dutch Data Privacy Act. The Lessor require a deposit up to € 200. The Lessee may fulfill the deposit by credit card or cash. The Lessor will return the Lessee the deposit upon return of products. If the product is damaged, stolen or lost, the Lessor will deduct an amount from the deposit and request additional payment if required 

3.4. Payment for the rental of the Item(s) is to be made electronically to the Lessor's specified bank details.

4. Transfer and Return of the Item

4.1. The Item is transferred to the Lessee directly in the Lessor's showroom.

4.2. The Item must be returned by the Lessee to the Lessor's showroom by 5:00 PM on the last calendar day of the rental period.

4.3. The Lessee bears full material responsibility for the safety of the Item, as well as the risk of its loss, damage, or destruction from the moment the Item is received for use.

4.4. In case the Lessee violates the return deadline of the Property for more than 14 calendar days, the Lessee is considered to have expressed a desire to purchase the Property and shall undertake to pay the Lessor the whole price of such Property and additionally pay a fine of 10% of the value of such Property  within five business days from the moment the Lessor sends a written demand to the address of the Lessee 

5. Obligations of the Parties

5.1. The Lessee is obliged to:

5.1.1. Adhere to the Rental Rules of this Agreement, which are an integral part of it.

5.1.2. Handle the Item with care, for its intended purpose, in accordance with the terms of this Agreement and all Additional Agreements.

5.1.3. Return the Item to the Lessor in the same condition as it was at the beginning of the rental period.

5.1.4. Report any damage or stains on the Item to the Lessor within one day. 5.1.5. Compensate the Lessor for any damage caused, including full replacement of the Item in case of loss or destruction. In this case, the Lessee must pay the compensation within three days from the date of receipt of the invoice from the Lessor.

6. Liability of the Parties

6.1. In case of damage to the Item, the Lessee is obliged to compensate the Lessor for the cost of restorative repairs, dry cleaning, or other measures to restore the Item. The amount of compensation is determined by the Lessor, who provides the Lessee with an invoice that must be paid within three days from the date of receipt. The invoice is sent to the Lessee's email address, and it is considered received upon sending.

6.2. In case of loss of the Item, the Lessee is obligated to pay the Lessor the full value of the Item within three days from the end of the rental period.

6.3. In case of late return of the Item, the Lessee is obliged to pay the Lessor a penalty of 20% of the total rental value for each day of delay. Payment of this penalty does not release the Lessee from the obligation to return the Item. If the Item is not returned within ten days from the end of the rental period, the Lessee is obligated, in addition to the penalty, to pay the full value of the Item as indicated on the mangata-store.com website.

6.4. The Parties have approved the following list of non-remediable deficiencies in the Property, as a result of which the Property is deemed to have lost its commercial appearance and can no longer be rented to third parties:

A) Stains:

  • Stains treated at home (washed, rubbed with various types of cloths, treated with solvents, smoothed out).

  • Stains left by perfumes, tanning products, various types of glue, bitumen, varnishes (acrylic, nitro), construction foam, gel pens, alcohol cocktails with food dyes, hot grease.

  • Water stains caused by water solutions (wine, champagne, rain, urine, etc.).

  • Sweat stains (color loss).

B) Damage:

  • Tears not along seams or near stitching lines.

  • Fading, other damage due to thermal effects.

  • Loss of component parts and elements.

7. Cancellation Costs

If an agreement is canceled by the hirer, the lender can charge the following cancellation costs:

  • In the event of cancellation up to the 30th day (exclusive) before the rental date: the deposit, up to a maximum of 10% of the rent.
  • In the event of cancellation from the 30th day (inclusive) up to the 7th day (exclusive) before the rental date: 30% of the rent.
  • In the event of cancellation from the 7th day (inclusive) up to the 3rd day (exclusive) before the rental date: 50% of the rent.
  • In the event of cancellation from the 3rd day (inclusive) up to the 1st day (exclusive) before the rental date: 90% of the rent.
  • In the event of cancellation less than 1 day before the rental date: the full rent.

8. Confirmation of Acceptance

By renting headpieces from Mangata Store B.V, you acknowledge that you have read and agreed to abide by our terms and conditions.

RENTAL RULES

These Rules are mandatory for compliance and are an integral part of the Public Offer Agreement (hereinafter referred to as the "Agreement"). 

  1. Changes to the appearance of the Item or self-destruction of stains on the Item are not allowed.
  2. The rental cost, as indicated on the mangata-store.com website, covers a 2-day rental period (1 night). 
  3. The rental cost includes minor repairs (such as torn seams, detached buttons or beads/sequins), and overall dry cleaning, including easy-to-remove stains.
  4. In case the Item is damaged and requires repair or has hard-to-remove stains (e.g., grass, mud, wine), the Lessor will perform repairs and/or additional cleaning of the Item, and the Lessee is required to fully compensate the Lessor for the expenses incurred for repair and/or cleaning, as specified in the invoice provided by the Lessor.
  5. In case the Item is damaged beyond repair and cannot be cleaned, the Lessee is required to purchase the Item within three days from the moment of receiving a notification sent to their email address, phone number, or the address provided in the Agreement. The purchase price of the Item is determined by the value of the Item as indicated on the website mangata-store.com. The Lessee is not allowed to transfer the Item to third parties 
  6. Damage that renders the Item unfit for use includes complete or partial loss of color, complete or partial change in fabric texture, loss of original hardware that cannot be replaced, non-removable defects/damage such as holes or stains, and the loss of parts of the set or integral parts of the Item. The list of damages provided in this section is not exhaustive, and the Lessor reserves the right to independently determine the Item's unsuitability.
  7. In case of early order placement, there is a likelihood of changes in the appearance of the Item and its wear and tear (in such cases, the Item is removed from the website), as determined by other rentals of the Item. In such cases, the Lessor is not responsible for changes in the Item's condition and the inability to rent the Item.
